First a few words of explanation of the workings of the English probate system:

The Borthwick Institute of Historical Research is situated in the medieval guild hall of St Anthony the Hermit
near the centre of York.
It takes its name from William Borthwick of Bridlington, under whose will it was endowed.
It was opened in 1953 and ten years later became part of the newly-established University of York
as a research institute specialising in the study of ecclesiastical history, in particular that of the Province of York.
It acts as the diocesan record office for Yorkshire and is a recognised place of deposit for public records.


Wills Before January 1858

A complicated network of probate courts existed to deal with the distribution of property following a person's death.
The majority of business took place in the courts of bishops,
with each bishop enjoying probate jurisdiction within most of his own diocese.
The right to grant probate could, however, be attached to peculiar jurisdictions, or to manorial courts,
presided over by ecclesiastical or lay lords. These jurisdictions sometimes covered only one village,
but could cover wider areas.
There were in addition two higher levels of jurisdiction above each diocesan bishop.
When a testator had goods in more than one diocese of the Northern Province (diocese of Chester, Carlisle, Durham or York),
or in more than one jurisdiction within the Northern Province
(eg. goods in both a peculiar of Dean and Chapter and in the jurisdiction of the archbishop)
the Prerogative Court of York had the right to grant probate.
If the testator had goods within both the northern and southern province then the Prerogative Court of Canterbury
had the right to grant probate. For records of the Prerogative Court of Canterbury contact the Family Record Centre
 

This system was dismantled in 1858, when civil probate registries were established.

This is the Last Will and Testament of me Daniel Joslin of Braintree in the County of Essex Gentleman. I give and devise unto my son Thomas Joslin and to his heirs and assigns All that my messuage or tenament and shop with the yards gardens outhouses [……] ways casements and appurtenances to the same belonging now in his occupation together with so much of the present brew house used by my said son Thomas Joslin and myself in common as was the original brew house but not the lean-to erected by me to enlarge the same AND also all that messuage tenement and shop with the hereditaments and appurtenances to the same belonging now in the occupation of Sarah Burman widow except as not intended to be hereby devised to my son Thomas Joslin the lower room and two chambers now in the occupation of the said Sarah Burman and which formerly belonged to and formed part of the messuage or tenement in which I now reside and also all that garden usually called the Middle garden which also formerly belonged to the messuage and hereditaments now in my own occupation and also all that orchard piece or parcel of ground lying beyond the said Middle garden which I purchased of Charles Marsh and Catharine his wife together with a right of way and passage through the yard of Mr Samuel Tunbridge over which he hath by sufferance erected a lean-to as all the said premises are situate in Braintree aforesaid and I give and bequeath to my said son Thomas Joslin the small piece of leasehold ground on part of which I have erected a Chaise House and the rest is laid to the yard belonging to the said messuage or tenement and shop in his own occupation AND I give and devise unto my son Robert Joslin and to his heirs and assigns all that my messuage or tenement in which I now dwell with the garden [yard] ways waters easements hereditaments and appurtenances to the same belonging together with the lean to erected by me to enlarge the before mentioned Brew house and the said lower room and two chambers now in the occupation of the said Sarah Burman with the hereditaments and appurtenances to the same belonging AND I do hereby will and direct that my said two sons Thomas Joslin and Robert Joslin shall at their joint expence, within six months after my decease, unless I shall have done the same in my life time, erect a brick wall separating the said original Brew house from the lean-to before mentioned so that the said Brew house and the lean to may be effectually divided and the Brew house held and enjoyed by my said son Thomas Joslin his heirs and assigns separately from the said lean-to and the said lean to held by the said Robert Joslin his heirs and assigns separately from the said Brew house. I also give and devise unto my said son Robert Joslin and to his heirs and assigns all those my two cottages or tenements situate in the [h?or p? yard?] in Braintree aforesaid one of which was formerly a stable and now occupied or possessed as part of or belonging to the messuage or tenement in which I now dwell and the other I purchased of the late Mr Samuel Bright and was formerly used as an engine house AND also all that messuage or tenement and shop situate in Chelmsford in the same County now in the occupation of my said son Robert Joslin with the houses outhouses yards gardens ways waters lights easements hereditaments appurtenances to the same belonging or by my said son Robert Joslin held used occupied or enjoyed therewith and also all that xxx close or parcel of land situate in Stebbing in the said county with the hereditaments and appurtenances to the same belonging which I purchased of the trustees of the will of John Joslin Gentleman deceased AND I give and bequeath to my sister Sarah Clarence the annual sum of sixty pounds free and clear of all legacy dues and other duties to be paid by equal half yearly payments and the first half yearly payment thereof to be paid at the end of six calendar months next after my decease
AND I hereby direct that before any division or distribution of the residue of my personal estate and effects shall be made either a [government] life annuity of sixty pounds clear of all deductions shall be purchased in the name of and for the [sole] use of my said sister or that a sufficient sum shall be reserved and set apart by my executors hereinafter named for the payment of such annuity half yearly to my said sister for……AND after purchasing the said annuity or making sufficient provision for the payment thereof and after the payment of all my just debts my funeral expenses the charges of proving and in attending the execution of this my will and other incidental expenses I give and bequeath all the [rest? ] residue and remainder of my goods chattels personal estate whatsoever and where so ever unto my three sons
Thomas Joslin Robert Joslin and George Joslin to be equally divided between them share and share alike AND I hereby nominate constitute and appoint my said three sons Thomas Joslin Robert Joslin and George Joslin Executors of this my last will and Testament and I do revoke all former and other writs and testamentary papers by me at any time heretofore made and do declare this to be my last will and testament in witness whereof I the said Daniel Joslin the testator have to this my last will and testament contained in two sheets of paper set my hand to the first sheet and to this second and last sheet my hand and seal this twenty seventh day of December in the year of our Lord one thousand eight hundred twenty five. THIS IS A CODICIL to the last will and testament of me
Daniel Joslin of Braintree in the County of Essex Gentleman bearing date on or about the twenty seventh day of December one thousand eight hundred and twenty five whereas I have in and by my said Will given and bequeathed to my sister Sarah Clarence an annuity or clear yearly sum of sixty pounds to be raised and paid out of my personal estate and whereas I am entitled to the sum of six hundred pounds secured to me by a certain mortgage in [for or fee] and a certain conditional surrender made to me by Henry [Chigwell] And I am in possession of the mortgaged estates or in the receipt of the rents and profits of the same on the forfeiture of the conditions of the said mortgage and surrender or otherwise now I do hereby will and direct that the said mortgage debt and all securities for the same and the rents [….. ]of the mortgaged premises shall be applicable [xxxx] to the paying and satisfying the said annuity in manner in my said will mentioned AND that my heir at law or other person [entitled] To the legal estate and Interest of and in the said Mortgaged premises shall stand occupied thereof subject to the trusts in the said securities contained In trust to make provision for paying and satisfying the said annuity so far the same will extend and I do hereby will and direct that the real estate in and by my said will given and devised to my son Thomas Joslin and his heirs shall be charged with and subject and liable to the payment of one moiety or half part of so much of the said annuity as the said Mortgage debt Interest rents and profits shall not be sufficient to pay and satisfy and that the real estate situate in Braintree aforesaid in and by my said will given and devised to my son Robert Joslin shall be charged with and subject and liable to the payment of the other half part of so much of the said annuity as the said mortgage debt interest rents and profits shall not be sufficient to pay and satisfy AND that the rest and residue of my personal estate and effects save and except the said mortgage debt shall not be subject or applicable to the raising and paying the said annuity or any part thereof and I do hereby will and direct that on non payment of the said annuity or any part thereof in manner in my said will mentioned my said sister shall and may enter into and upon the premises respectively hereby charged with the payment of the same in part and distrain for the same and all arrears thereof and all expences to be incurred by such non payment in the same manner as landlords may lawfully do to recover rents in arrear reserved in and by any demise or lease and so from time to time as often as the xxx said annuity shall be in arrear and unpaid in all other respects I ratify and confirm my said will In witness where of I have and hereunto set my hand and seal the twenty eighth day of January one thousand eight hundred and twenty nine (28th January 1829)

Peter Walter Joslin (Joslin Research)
Daniel JOSLIN born 1755 (my BK#9502) was the son of John JOSLIN of Stebbing and Jane SWAN
who married at Great Yeldham Essex on 3rd December 1775.
Johns
parents were
John JOSLIN and Sarah CLOPSTON of Stebbing Essex.

Daniel was known to have siblings:
John and William and a sister Sarah who married John CLARENCE,
other Joslin's also married into the CLARENCE family in the Essex area.

Daniel JOSLIN and his wife Elizabeth CLARENCE married at Great Samford Essex in 1777
they had a least eight children of which the eldest: Thomas was said to work as a Draper of Braintree.
Their Son George was said to be the well known Master Iron monger of Colchester who married Elizabeth CRUSH.
Daniel was buried at St Michael the Archangel Braintree on the 14th April 1829 (no inscription survives today)
